1. Introduction 
These Terms govern your use of Steel Pulse Magic Studio ("we," "us," "our") website and services. By accessing or purchasing, you agree to these Terms. If not, do not use our site.

2. Age Restriction 
Strictly 18+. Our content is mature/NSFW. By using, you confirm you are of legal adult age in your jurisdiction.

3. User Conduct  
- No illegal activities, harassment, or misuse.  
- Do not reproduce, distribute, or resell our content without permission.  
- We may terminate access for violations.

4. Products and Sales  
- All sales final; no refunds due to mature/digital nature (see Return Policy).  
- Digital downloads: Non-refundable once accessed.  
- Printed items: As described; colors may vary.

5. Intellectual Property and Content Disclaimer  
All content (art, designs) is owned by us. Limited personal use license granted upon purchase. No commercial use.  
All artwork is original, created by Steel Pulse Magic Studio, and protected by copyright. All depicted models and characters are fictional adults aged 18 or older, intended solely for entertainment and artistic admiration. Any resemblance to real persons, living or deceased, is purely coincidental and unintentional.

6. Payments and Shipping  
- Secure payments via Shopify.  
- Shipping via USPS; rates calculated at checkout.  
- International: Buyer responsible for duties/taxes.

7. Disclaimers 
Content provided "as is." No warranties. We are not liable for indirect damages.

8. Limitation of Liability  
Our liability limited to purchase price. Not liable for consequential losses.

9. Governing Law  
Governed by California, United States laws. Disputes resolved in California State courts.

10. Changes  
We may update Terms; continued use means acceptance. Check periodically.

11. Website Use Restrictions

You may not use automated tools, scripts, or bots to access, scrape, or download content from our website. Bulk downloading of images, designs, or content is prohibited. You may not use our website for competitive research or reverse engineering our design work. Violating these restrictions may result in immediate account suspension and legal action.

 

12. Dispute Resolution

Before filing any legal claim, you agree to attempt to resolve the dispute by contacting us at support@steelpulsemaginc.com. We will make reasonable efforts to resolve disputes within 30 days. If we cannot resolve your dispute, you may pursue legal remedies as permitted by law. All disputes are subject to the governing law and jurisdiction specified in Section 9.

 

13. User Indemnification

You agree to indemnify and hold harmless Steel Pulse Magic Studio, its owners, operators, and employees from any claims, damages, losses, and expenses (including legal fees) arising from: (a) your use of the website or services; (b) your violation of these Terms; (c) your infringement of any intellectual property or privacy rights of others; or (d) any content you submit or transmit through the website.

 

14. Termination of Access

Steel Pulse Magic Studio reserves the right to suspend or terminate your access to the website and services, with or without notice, for conduct that violates these Terms of Service, including but not limited to: unauthorized access, infringement of intellectual property, illegal activities, or violation of website use policies. Upon termination, all rights granted to you will cease, and you must immediately stop using the website.

 

15. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be severed, and the remaining provisions shall remain in full force and effect. The invalidity of one provision does not affect the validity or enforceability of any other provision.

 

16. Product Specifics - Digital vs. Physical Items

Digital Downloads: All digital products, including artwork, designs, and downloadable files, are non-refundable once purchased and downloaded or accessed. A digital product is considered 'accessed' once any download begins or a preview is viewed. Physical Products: Physical items sold on our website (prints, merchandise, etc.) are subject to our Return and Refund Policy. Physical items must be reported as damaged or defective within 14 days of receipt.

 

17. Payment Terms and Procedures

Payment Processing: All payments are processed securely through Shopify and accepted payment gateways. By placing an order, you authorize us to charge your selected payment method. Payment Disputes: If you believe a charge is unauthorized or incorrect, contact customersupport@steelpulsemstudio.com within 30 days. We reserve the right to pursue chargeback claims to the fullest extent permitted by law. Failed Payments: If your payment fails, your order will not be processed. You may be required to update your payment information and resubmit.
